The total share of second homes declined from 36 percent of transactions in 2006. &lt;br /&gt;NAR’s annual Investment and Vacation Home Buyers Survey shows vacation-home sales dropped 30.6 percent to 740,000 in 2007 from a record 1.07 million in 2006, while investment-home sales fell 18.1 percent to 1.35 million last year from 1.65 million in 2006.  At the same time, primary residence sales declined 10.0 percent to 4.34 million in 2007 from 4.82 million in 2006.&lt;br /&gt;Lawrence Yun, NAR chief economist, said the findings suggest different cycles for each of the sectors over the past two years.  “Investment-home sales declined sharply in 2006 as speculators disappeared, leaving the market to serious buyers, with the pattern continuing in 2007,” he said.  “Vacation-home sales rose to a new record in 2006 because there was a pent-up demand from buyers who couldn’t find a property as a result of tight supplies in preceding years.”&lt;br /&gt;The overall sales decline in 2007 resulted from a combination of factors.  “Certainly, second homes are discretionary purchases and there is a natural tendency to pull back from big-ticket items in periods of uncertainty,” Yun said.  “The other factor is the disruption in the mortgage market, with a significant tightening of credit during the second half of 2007.  Some buyers simply adopted a wait-and-see attitude.” Yun said lifestyle factors and strong demographics remain positive for the vacation home market.  “Investment considerations are secondary for vacation-home buyers, so there is some dormant underlying demand,” he said.  “A peak of population is moving through the prime years for buying recreational property. Seemingly bad news which is really good news, and why IT IS IMPORTANT IN MEXICO TO USE ONLY AMPI &amp;amp; NAR PROFESSIONALS!&lt;br /&gt;&lt;br /&gt;Way Too Many REALTORS®?&lt;br /&gt;By NAR Chief Economist Lawrence Yun&lt;br /&gt;&lt;br /&gt;NAR membership figures have finally begun to fall.  Whew!!! &lt;br /&gt;&lt;br /&gt;The number of REALTORS® grew from 750,000 at the turn of this decade to close to 1,370,000 as recently as August 2007.  That is an addition of 83 percent in short seven years.  From 1980 to 2000, membership figures bounced around in the narrow band of 620,000 to 820,000.&lt;br /&gt;  &lt;br /&gt;Such a rapid increase in membership is not necessarily healthy.  How many of the new members have ever seen a down market aside from the last two years?   How many understand the importance of repeat and referral business and not just a single transaction?&lt;br /&gt;&lt;br /&gt;Given that about ½ million REALTORS® have less than 5 years of experience, sloppiness in some transactions no doubt exists.  A complaint I hear quite frequently from REALTORS® is about the second-rate conduct of some of their fellow new members. &lt;br /&gt;&lt;br /&gt;Every attempt by state and local REALTOR® associations to further raise professional standards gets knocked down by government regulators as hindering competition.  NAR has made efforts to strengthen professional standards and the code of ethics but has been careful, knowing that the Department of Justice and Federal Trade Commission will be breathing down our neck.  &lt;br /&gt;&lt;br /&gt;Fortunately though, consumers are smart and can navigate through in finding the right REALTOR®.  When asked, 68 percent of recent homebuyers said they would definitely use their REALTOR® again or recommend their REALTOR® to others.  An additional 19 percent said probably use again.   For home sellers, the figures were 62 percent definitely and 19 percent probably. &lt;br /&gt;&lt;br /&gt;The vast majority of REALTORS® are, therefore, serving their clients in the most professional way, and understands that &lt;a href="http://www.realtors.org/research/commentary_consumerroyalty.html" target="blank"&gt;consumer interest is their interest&lt;/a&gt;.&lt;br /&gt;Business seems brutally competitive at times.  With sales activity trending at 10-year lows in recent months, that is all the more accurate.  Still, business is entrepreneurial and that means there are a multitude of business models and widely varying levels of professionalism among members. &lt;br /&gt;&lt;br /&gt;Entrepreneurial businesses tend to follow the 80-20 rule of 80 percent of the business activity being conducted by 20 percent of the people.  In real estate, a similar type of figures show that top 20 percent of REALTORS® earned a median income of $175,000 while the bottom 20 percent earned less than $10,000.  The figures are from NAR's survey of members and reflect business activity in 2006. &lt;br /&gt;&lt;br /&gt;With home sales having fallen 13 percent in 2007, the competition is no doubt more intense.  The membership figure is now turning sharply lower.  Perhaps this is what is needed to boost the overall professionalism of members. &lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;"&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;"&gt;The global luxury residential market has been largely unaffected by the real estate slowdown. Knight Frank's 2007 Annual Wealth Report looks at the behavior and attitudes of high net worth individuals (HNWIs) as they relate to the residential property market. HNWIs view their residential portfolio as an opportunity for lifestyle enjoyment, individuality and exclusivity. &lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;"&gt;They are aggressive investors and differ from other investors in their attitude toward risk and reward. HNWIs have a higher than average weighting in residential property and their portfolio is internationally diverse. &lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;"&gt;They are happy to invest in emerging economies and are open-minded to alternative investment locations. The report names three key drivers of HNWIs in the purchase of a prime residence or a second home: Time Poverty (convenience and accessibility), Luxury and Prestige. These drivers keep HNWIs pushing at the edge of the market, as they seek to keep ahead of the market either by bidding up prices to retain exclusivity or by exploring new markets. &lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;"&gt;History shows that where this market niche goes in terms of location and property types, the rest of the market will follow. The study was primarily conducted with UK residents resulting in a somewhat UK/European bent to the report (valuable to brokers serving these investors), but many of the trends outlined are likely applicable to all HNWIs, e.g., the importance of tax issues as they relate to property. Prior to 1973, foreigners were not allowed to hold legal title or exercise direct rights to real property in an area within 64 miles of Mexico's borders and 32 miles of its coasts. But laws passed in 1973 and1993 have made it possible for foreigners, foreign firms and Mexican firms with foreign participation to acquire interests in coastal real estate through a bank trust (Fideicomiso).&lt;br /&gt;Q: Who is involved in this bank trust?&lt;br /&gt;Three parties. The seller of the property is the Trustor. The bank is the Trustee. (Fiduciario), and the buyer, or Beneficiary (Fideicomisario).&lt;br /&gt;Q: How does the trust function?&lt;br /&gt;Title to the property is transferred to a trust with a Mexican bank acting as Trustee. The Trust Agreement is formalized by the issuance of a permit from the Mexican Ministry of Foreign Affairs. The lot or home buyer is designated as Beneficiary in the Trust and the beneficiary rights are recorded in the public record by a Notary Public.&lt;br /&gt;Q: What are my rights as a buyer?&lt;br /&gt;The trust is a legal substitute for fee simple ownership, but in this case, the Trustee is the legal holder of the property. As Beneficiary, you have the right to sell your property without restriction. You may also transfer your rights to a third party, or pass it on to named heirs.&lt;br /&gt;Q: Is the trust renewable?&lt;br /&gt;Yes. According to the Foreign Investment Law passed in 1993, trusts can be renewed for an indefinite number of successive 50 year periods. In effect they run in perpetuity.&lt;br /&gt;Q: If at a later date, I decide to sell my property can anyone buy it?&lt;br /&gt;Yes. If the buyer is also a foreigner, you simply assign beneficial rights. If the new buyer is a Mexican National, you can instruct the bank to endorse the title in favor of the buyer.&lt;br /&gt;Q: If the buyers is a foreigner, is his interest limited to the balance of my 50 year trust?&lt;br /&gt;No. Upon application, a foreigner automatically receives his own renewal 50 year permit. This, however, is not mandatory.&lt;br /&gt;Q: Do many foreigners currently own coastal property in Mexico?&lt;br /&gt;Yes. Jay West, CIPS, RSPS, &lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:verdana;"&gt;TRC Coordinator, Region III B (Baja California Sur &amp;amp; Sonora)&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:verdana;"&gt;AMPI Nacional (Mexican Association of Real Estate Professionals)&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:verdana;font-size:85%;"&gt;Humankind is currently experiencing the largest transfer of wealth from one generation to the next. The numbers are staggering! According to estimates, Baby Boomers in the U.S. will inherit between $30 and $40 TRILLION Dollars by the time the last of that generation reaches 60 years old.&lt;br /&gt;&lt;br /&gt;The latest survey released on May 11, 2006 by the National Association of REALTORS (NAR), states that baby boomers continue to dominate the market, and a growing number of second homes more than one-in-ten are owned by minorities. A surprising majority of respondents own multiple properties in addition to their primary residence.&lt;br /&gt;&lt;br /&gt;David Lereah, NARs chief economist, says the market continues to be dominated by the baby boom generation.&lt;br /&gt;Middle-aged, middle-income households are the driving factor in the second-home market, with favorable demographics providing a solid fundamental demand in this sector for the next decade, Lereah says. Boomers believe in diversifying their assets, and most second-home owners see their purchase as being a better investment than stocks. A surprising majority of survey respondents hold multiple properties, and they are interested in purchasing additional homes. About six in ten respondents own two or more homes in addition to their primary residence.&lt;br /&gt;&lt;br /&gt;In other words, despite market bubbles and changing population trends in housing, the Resort and Second-Home segment of the real estate market will be where the action is for years to come. Nowhere is this going to be more true than in beachfront destination resorts like Los Cabos where investment returns, lifestyle and recreation diversity, safety, and geographic accessibility come together to create a truly unique opportunity for the affluent Boomers.&lt;br /&gt;Ask anyone who has owned a resort second-home here in Los Cabos if their investment has been a good one. They will probably look at you with a quizzical what planet are you from? stare. &lt;br /&gt;NAR President Thomas M. Stevens from Vienna, Va., says the term second home appears to be something of a misnomer. The fact that so many owners of vacation homes and investment property have additional properties is a bit of a revelation. What we see now is a crossover between largely vacation- and investment-home owners, with people recognizing the value of those investments and pouring more assets into real estate.&lt;br /&gt;The survey goes on to say that the typical vacation-home owner is 59 years old, earned $120,600 last year, and purchased a property that is 220 miles from their primary residence, but 34 percent were less than 100 miles and another 34 percent were 500 miles or more. Eighty-three percent of owners are married couples.&lt;br /&gt;&lt;br /&gt;Three-fourths of vacation-home owners purchased for personal use, although one-third also wanted to diversify investments, and 18 percent intended that the home would become a primary residence in retirement. Only 13 percent of vacation owners listed rental income as a reason to buy. The typical owner spends 39 nights per year at their property, and three-quarters do not rent out. Of those who do rent their vacation home, the median number is 12 nights per year.&lt;br /&gt;&lt;br /&gt;If you are visiting Los Cabos for the first time, you may want to seek out a REALTOR (In Mexico, a REALTOR must be a member of the Mexican Association of Real Estate Professionals (AMPI) and the National Association of REALTORS). Take a few moments to discuss the many opportunities to own property in one of the worlds most talked about and desirable resort destinations. &lt;br /&gt;If you are returning to Los Cabos and are asking yourself how come I never invested here before the prices went through the roof? The short answer is that there is still time to participate in the Cabo Boom. Also, take a look at the emerging areas, particularly up in the famous East Cape on Bahia Las Palmas (Los Barriles and Buena Vista). After all, that is where the FIRST Los Cabos resort was built in 1951 at Rancho Buena Vista, and where today you will find the same breathtaking beauty that has attracted the famous and the seekers of serenity for decades. The prices are less than one-half the Cabo market.&lt;br /&gt;&lt;br /&gt;Other areas to consider are Todos Santos, Elias Calles, La Paz and even the washboard dirt road north of Punta Gorda to Cabo Pulmo. Words of caution.ALWAYS make sure the title is clean and you will receive yours in a timely manner. The number was staggering.  82,200,000 responses to the simple four letter word Cabo.&lt;br /&gt;&lt;br /&gt;I then tried a Yahoo search.  24,600,000!  I narrowed it down to Cabo real estate on Yahoo.  Only 902,000.ah, thats better?&lt;br /&gt;&lt;br /&gt;A decade ago, I put my first Cabo website on-line.  I am no longer using it today, but back then when &lt;/span&gt;&lt;a href="http://www.cabosun.com/"&gt;&lt;span style="font-family:verdana;font-size:85%;"&gt;www.cabosun.com&lt;/span&gt;&lt;/a&gt;&lt;span style="font-family:verdana;font-size:85%;"&gt; was new, the word Cabo on Yahoo had fewer than 20 search responses!  What happened?  Where did this internet thing come from?  Who is using it?  And why are there 82 MILLION entries for Cabo on Google?&lt;br /&gt;&lt;br /&gt;We are booming because the Boomers are blooming!  And resort real estate is going to be hot for the next decade.  In sales jargon, I am talking sizzling hot.  Especially the accessible vacation and retirement resort destinations with undeveloped real estate close to or on the water.  Especially places like Los Cabos and the Baja, because we have some of the best water in the world.  Imagine that!  Coming to Mexico because of the water!&lt;br /&gt;&lt;br /&gt;Los Cabos is the 2nd fastest growing municipality in Mexico after Cancun.  It has one of the healthiest economies in Mexico and is one of the top destinations in the hemisphere.  Millions of the Baby Boomer generation are shopping for second or retirement homes in markets like Los Cabos.  There is no end in sight.&lt;br /&gt;&lt;br /&gt;Some more food for thought from the National Association of REALTORS in the U.S.A.:&lt;br /&gt;&lt;br /&gt;In 2004, the National Association of REALTORS (NAR) identified over 108,000 resort and second-home specialists through its network of state and local boards and associations. Analysis of the 2005 Profile of Second-Home Buyers reveals that the number of REALTORS handling resort and second-home transactions is likely to be far greater than the 108,000. In 2004, there was a record 2.82 million second home sales, up 16.3 percent from 2.42 million in 2003. Vacation-home sales rose 19.8 percent to 1.02 million in 2004 from 850,000 in 2003. The vacation and second home market is undergoing a period of tremendous growth due to the impact of the Baby Boom generation and the heightened interest in real estate investment. NAR has been encouraging members to select their Field of Business specialty. To date, approximately 4,382 REALTORS have identified themselves as Resort Specialists.&lt;br /&gt;&lt;br /&gt;Member responses came from 46 states and the Virgin Islands. The following property types were recognized:44% Ocean38% Golf20% Lake18% Mountain11% Skiing&lt;br /&gt;&lt;br /&gt;As defined by NAR:  A Resort Specialist is a real estate practitioner who facilitates the buying, selling, or management of properties for investment, development, retirement, or second homes in a resort, recreational and/or vacation destination.&lt;br /&gt;&lt;br /&gt;NAR established a professional curriculum to earn the designation of Certified Resort and Second-Home Property Specialist and the first designees were named in January, 2006.  Three members of the Los Cabos real estate community were awarded the RSPS designation in the inaugural class including Julie Kershner, President of AMPI Los Cabos in 2006 (Prudential California Cabo Gold), and Teena Jones Broker/Co-owner of CaboRealty.
